GameSnap POS Terms of Service

These Terms of Service (“Terms”) govern access to and use of the GameSnap POS software platform and related services (the “Service”) operated by GameSnap (“GameSnap,” “we,” “us,” or “our”).

By creating an account, accessing, or using the Service, you (“Customer,” “User,” or “you”) agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.


1. Description of the Service

GameSnap provides a cloud-based point-of-sale and retail management platform designed for retail businesses. The Service may include features such as:

  • inventory management

  • integrated product catalogs

  • trade-in and buyback functionality

  • payment processing integrations

  • ecommerce integrations

  • reporting and analytics

  • messaging and notification tools

  • hardware integrations

  • integrations with third-party services.

GameSnap may modify, improve, or discontinue features of the Service at any time.


2. Account Registration and Responsibilities

Customers are responsible for:

  • maintaining the confidentiality of their login credentials

  • ensuring that all authorized users comply with these Terms

  • all activity occurring under their account.

Customers must provide accurate and up-to-date information when registering for the Service.

GameSnap is not responsible for unauthorized account access resulting from failure to safeguard credentials.


3. Subscription Plans and Billing

3.1 Subscription Fees

GameSnap is offered on a subscription basis. Customers agree to pay all fees associated with their selected subscription plan.

Fees may include:

  • recurring subscription fees

  • optional add-ons or modules

  • usage-based charges or overages

  • payment processing fees where applicable.

All fees are exclusive of applicable taxes unless otherwise stated.


3.2 Billing Authorization

Customers authorize GameSnap to charge the payment method on file for all applicable fees.

Failure to maintain a valid payment method may result in suspension or termination of the Service.


3.3 Refund Policy

Except where required by applicable law, all subscription fees are non-refundable.

If GameSnap elects to provide refunds related to:

  • subscription downgrades

  • billing corrections

  • promotional adjustments

  • service credits

such refunds will generally be issued as account credit applied to the Customer’s GameSnap account, rather than cash refunds.

Account credits may be used toward future subscription charges.


3.4 Pricing Changes and Grandfathered Pricing

GameSnap may modify subscription pricing from time to time.

Customers with an active subscription at the time of a pricing change may retain their existing pricing (“Grandfathered Pricing”) provided that:

  • the subscription remains active, and

  • the Customer does not upgrade, downgrade, or otherwise modify the subscription plan.

If the plan is changed or canceled and later reactivated, the Customer may become subject to the current pricing in effect.

Grandfathered pricing does not apply to limited-time promotional pricing, including introductory discounts or promotional campaigns.


4. Payment Processing

4.1 Integrated Payment Processing

GameSnap may provide integrated payment processing through approved merchant service providers.

If a Customer opens a merchant account through GameSnap or its integrated partners, that merchant account must be used for transactions processed through the GameSnap POS system.

Customers may not route transactions through external processors while using a GameSnap-integrated merchant account.


4.2 Merchant Program Compliance

Customers participating in GameSnap’s merchant account program agree to comply with all requirements established by:

  • First Data / Fiserv / CardConnect

  • acquiring banks

  • applicable card networks (Visa, Mastercard, American Express, Discover).

Customers must comply with all applicable payment industry regulations including PCI DSS requirements.

GameSnap does not control underwriting decisions, reserves, or other actions taken by payment processors.


5. Chargebacks and Payment Disputes

Customers are solely responsible for transactions processed through their merchant account, including chargebacks and payment disputes.

All actions related to disputes must comply with the applicable rules of the merchant account program, including requirements imposed by:

  • First Data / CardConnect

  • the acquiring bank

  • card network rules.

GameSnap is not responsible for:

  • fraudulent transactions

  • chargebacks

  • dispute outcomes

  • processor-imposed penalties.


6. Integrated Product Catalogs and Third-Party Data

The Service may include product catalogs or data obtained from third-party sources.

GameSnap does not guarantee the accuracy or completeness of such data.

6.1 PriceCharting API Requirement

Certain catalog functionality relies on the PriceCharting API.

By enabling PriceCharting features, Customers represent and warrant that they maintain an active PriceCharting Legendary Plan or other required API license.

GameSnap does not verify or enforce PriceCharting subscription status and assumes no responsibility for ensuring compliance with PriceCharting licensing requirements.

Customers are solely responsible for compliance with third-party data licensing obligations.


7. Messaging and Communications Compliance

GameSnap may provide tools enabling Customers to send SMS messages, emails, or other communications to their customers.

These services may utilize third-party providers such as Twilio.

Customers are solely responsible for ensuring compliance with all applicable messaging laws including:

  • Telephone Consumer Protection Act (TCPA)

  • CAN-SPAM Act

  • FCC regulations

  • applicable telecommunications and privacy laws.

Customers must obtain appropriate consent from recipients before sending automated communications.

Customers must comply with the terms and acceptable use policies of messaging providers including Twilio.

GameSnap is not responsible for compliance violations related to messaging activities.


8. Customer Compliance Responsibilities

Customers represent and warrant that their use of the Service complies with all applicable laws and third-party agreements, including those related to:

  • payment processing

  • messaging communications

  • data licensing

  • consumer protection regulations.

Customers are solely responsible for ensuring compliance with such obligations.


9. Inventory Data Integrity Disclaimer

Inventory counts, stock levels, and product data within the Service depend on data entered by Customers or transmitted through integrations.

GameSnap does not guarantee that inventory data will be free from discrepancies.

Inventory discrepancies may occur due to:

  • incorrect data entry

  • synchronization delays

  • third-party integration errors

  • user actions

  • system updates or interruptions.

Customers are responsible for periodically verifying the accuracy of their inventory records.

GameSnap shall not be liable for losses arising from inventory discrepancies or pricing errors.


10. Inventory and Pricing Data Disclaimer

Suggested pricing, catalog information, and valuation data provided by the Service are informational only.

GameSnap does not guarantee the accuracy or timeliness of such data.

Customers are responsible for determining their own:

  • retail pricing

  • trade-in values

  • purchasing decisions.


11. Platform Usage Limits

GameSnap may impose reasonable usage limits to ensure system stability.

This may include restrictions on:

  • API requests

  • catalog queries

  • messaging volumes

  • automated data activity.

GameSnap may implement rate limits or safeguards to maintain platform reliability.


12. Anti-Circumvention

Customers may not circumvent platform safeguards, payment processing integrations, or usage controls in order to avoid applicable fees or restrictions.

Violation of this provision may result in suspension or termination of the account.


13. Hardware Compatibility

GameSnap may integrate with third-party hardware devices including:

  • receipt printers

  • barcode scanners

  • payment terminals

  • tablets or mobile devices.

GameSnap does not guarantee compatibility with all hardware configurations.

Customers are responsible for ensuring hardware compatibility with the Service.


14. Service Availability

GameSnap strives to maintain reliable availability but does not guarantee uninterrupted service.

Service interruptions may occur due to maintenance, technical issues, or third-party outages.

GameSnap is not liable for losses resulting from temporary service interruptions.


15. Operational Reliance and Business Continuity

The Service is intended to assist retail operations but should not be relied upon as the sole system for critical business records.

Customers are responsible for maintaining reasonable business continuity practices.

GameSnap shall not be liable for losses resulting from:

  • service outages

  • internet connectivity issues

  • hardware failures

  • third-party service disruptions.


16. Confidentiality

Each party agrees to protect confidential information disclosed by the other party.

Confidential information includes proprietary software functionality, internal processes, non-public pricing data, and customer transaction information.

Neither party shall disclose such information without consent.


17. Data Ownership and Backups

Customers retain ownership of the data they enter into the Service.

Customers grant GameSnap a limited license to process and store such data as necessary to operate the Service.

Customers are responsible for maintaining independent backups of critical business records.


18. Account Suspension and Termination

GameSnap may suspend or terminate accounts for reasons including:

  • non-payment

  • violation of these Terms

  • fraudulent or illegal activity

  • violation of payment processor rules.

Immediate suspension may occur where necessary to mitigate risk.


19. Data Export and Account Closure

Customers may request a data export within 30 days following account termination.

GameSnap will make reasonable efforts to provide data exports in a commonly used format.

After this period, GameSnap may permanently delete stored data.

GameSnap is not responsible for maintaining long-term archives following account closure.


20. Intellectual Property

The Service, including software, user interface, and system architecture, is the intellectual property of GameSnap.

Customers may not:

  • reverse engineer the Service

  • reproduce platform functionality

  • build competing services based on the platform.


21. Restrictions on Data Export Use

Exported data may only be used for the operation of the Customer’s own business.

Customers may not use exported data to recreate or replicate the functionality of the Service or build competing software.


22. Publicity

GameSnap may identify Customer as a user of the Service and may use Customer’s business name and logo in marketing materials, unless Customer requests otherwise.


23. Defamation and Harmful Conduct

Customers agree not to make knowingly false or misleading statements intended to harm the reputation of GameSnap.

This includes publishing defamatory or libelous statements regarding the Service.

This provision does not restrict legitimate criticism or honest feedback.


24. Taxes and Regulatory Compliance

Customers are responsible for determining, collecting, reporting, and remitting all applicable taxes related to their business transactions.

GameSnap is not responsible for tax compliance failures.


25. Limitation of Liability

To the maximum extent permitted by law, GameSnap shall not be liable for:

  • indirect or consequential damages

  • loss of revenue or profits

  • data loss

  • third-party service failures.

GameSnap’s total liability shall not exceed the subscription fees paid during the previous twelve (12) months.


26. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
